JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioner is languishing in custody since 21.03.2015 in a case registered for the offences punishable under Section 364(A) of the Indian Penal Code. The accusation is of kidnapping the informant from city civil court premises by one Rajiv Kumar and demanding rupees fifteen lacs as extortion but subsequently the informant escaped from the captivity after jumping from the roof of the house of Rajiv Kumar. The First Information Report was registered against Rajiv Kumar. The vehicle of the petitioner was found parked at the house of Rajiv Kumar when petitioner was arrested and his confession was obtained by the police.
It is submitted by learned counsel for the petitioner that for the occurrence of 02.08.2014 the First Information Report was registered on 06.08.2014 and on
Patna High Court Cr.Misc. No.26170 of 2015 (2) dt.24-07-2015 2/2 admission of the informant that he took rupees four lacs from Rajiv Kumar as a rent who was his tenant, co-accused Rajiv Kumar has been granted bail by this Court vide Cr. Misc. No. 9282 of 2015.
Considering the thrust of accusation against Rajiv Kumar who has been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City in connection with Alamganj P.S. Case No. 286 of 2014.
