ANJANA MISHRA ORAL ORDER 17-08-2017 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Sonpur P.S. Case No.463 of 2016 for allegedly having committed the offences under Sections 406, 420, 467, 468, 471, 120B, 496 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that though the allegation has been made against these petitioners by the complainant that Petitioner No.1 Janki Kuar had earlier registered the land in favour of her daughter-in-law Rinku
Patna High Court Cr.Misc. No.35802 of 2017 (2) dt.17-08-2017 2/2 Devi, yet there has been no such registry, for which petitioner no.1 has duly sworn an affidavit. As such, no case is made out against the petitioners for the offences, as alleged. Considering the aforementioned facts and circumstances and also because the dispute appears to be one of civil nature, the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, in connection with Sonpur P.S. Case No.463 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
