2. The petitioner seeks bail in connection with S.T. No. 443 of 2023 arising out of Kishanganj Rail P.S. Case No. 13 of 2023 registered for the offences under Section 304B, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is the husband of the deceased and he is alleged to killed the deceased for dowry after torturing her.

4. Learned counsel for the petitioner Shri Pankaj Kr. Sinha submits that since the trial has begun but the same is delayed and the petitioner may be granted bail.

5. Learned counsel for the informant has submitted

Patna High Court CR. MISC. No.67049 of 2024(2) dt.05-10-2024 2/2 that out of 17-18 witnesses, 8 witnesses have already been examined and he also undertakes to examine the other witnesses at the earliest.

6. Considering the aforesaid facts and also the fact that the trial has progressed, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. If the trial is delayed due to the fault of the prosecution side then the petitioner may renew his prayer for bail.
