It is alleged that 1 1⁄2 kg ganja was recovered from the house of the petitioner and on the same day, 1 kg ganja was recovered from the house of co-accused Hari Narayan Yadav.

Submission on behalf of the petitioner is that co-accused Hari Narayan Yadav has been granted bail by learned Sessions Judge, Darbhanga whereas prayer for bail of the petitioner was rejected by the same court, particularly, in the circumstance, when petitioner does not have any criminal antecedent and is languishing in jail custody since 25.2.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge/ District &
