Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) and other allied sections of the Bihar Prohibition and Excise Act, 2018. As per prosecution case, 2232 litres of foreign liquor has been recovered from container of the truck. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is neither driver nor owner of the truck in question. No incriminating material has been recovered from the conscious possession of the petitioner. Name of the petitioner has been transpired during course of investigation. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let

Patna High Court CR. MISC. No.59744 of 2022(2) dt.09-12-2022 2/2 the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, Court-1, Rohtas at Sasaram in Darihat P.
