JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-07-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Giriak Police Station Case No. 115 of 2017, disclosing offence under Section 135 of the Indian Electricity Act.

It is alleged against the petitioner that he was found tampering with the electric meter by creating a by-pass in electric connection and, thus, avoiding the meter, and thereby causing loss to the S.B.P.D.C.L., to the tune of Rs. 2,41,210/-.

Considering the nature of accusation, this application is allowed.

Patna High Court Cr.Misc. No.23671 of 2017() dt.20-07-2017 2/2 Let the petitioner, Udai Kumar, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Biharsharif, Nalanda, in connection with Giriak Police Station Case No. 115 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure, subject to the condition that the petitioner will pay 50 per cent of the loss amount to the S. B. P. D. C. L. within four week from today.

This is subject to the further condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled. It is indicated that the amount, so deposited, shall be without prejudice to any right/contention of the petitioner in any proceeding in relation to the quantum of loss, if any, caused to the S.B.P.D.C.L.
