Earlier the prayer for bail of the petitioners was rejected by this Court, vide order dated 7.9.2017 passed in Cr. Appeal (S.J.) No.2197 of 2017 with an observation to surrender within a period of four weeks and make prayer for regular bail, which will be considered on the basis of submission of the learned counsel for the petitioners.

Submission of the learned counsel for the petitioners is that the petitioner no.1 is aged about 80 years and he could not surrender and petitioner nos.2 and 3 are sons of the petitioner no.1 and as such they have prayed for some more time to surrender. Heard learned Spl.P.P. also.

Patna High Court Cr.Misc. No.18188 of 2018 (2) dt.11-04-2018 2/2 Having heard both sides, I find no reason to extend the time to surrender. The petitioners is at liberty to surrender within the reasonable time and make prayer for regular bail, which will be considered by the learned court below on the basis of material available on the record.

With the aforesaid observation, this application is dismissed.
