This application, for grant of anticipatory bail, arises out of Madhubani Town Police Station Case No. 302 of 2018, disclosing offences under Sections 147/149/323/341/504/353 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner, being the President of Non-formal Education Organization, Madhubani, organized a procession and blocked the road and in the process, caused inconvenience to the general public and motorists.

Learned Counsel for the petitioner submits that the petitioner was protesting against non-joining of Non-formal Education Instructors peacefully. He further submits that the

Patna High Court CR. MISC. No.59783 of 2019(2) dt.04-11-2019 2/2 members of the procession were not indulged in any vandalism, as would be evident from the First Information Report. He further submits that the petitioner has been made accused only because he happens to be the President of Non-formal Education Organization.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that no damage to the public property has taken place and the petitioner is the President of Non-formal Education Organization, I am inclined to grant the petitioners privilege of anticipatory bail. This application is, accordingly, allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town Police Station Case No. 302 of 2018, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
