The petitioner seeks bail in a case registered for the offence under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, co-accused Jitendra Paswan and Lalan Paswan shot dead brother-in-law (behnoi) of the informant, while he was returning by local train at Champapur Halt.

It is submitted on behalf of petitioner that name of the petitioner transpired in the confessional statement of co-accused Kundan Kumar @ Golu Kumar. As per F.I.R. itself, specific allegation of assault is against co-accused Jitendra Paswan and Lalan Paswan. Petitioner is in custody since 08.06.2021. Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Barh, District - Patna in connection with Bakhtiyarpur P.S. Case No. 75 of 2021.
