Petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A/34, 313, 314 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. The basis accusation is of torture for nonfulfillment of dowry demand and getting the pregnancy terminated.
It is submitted by the learned counsel for the petitioner that petitioner admits his marriage with the informant and pregnancy was terminated on the medical advice. At present the petitioner is not ready to keep the informant with her. Though, he is ready to make payment of
Patna High Court Cr.Misc. No.16041 of 2016 (3) dt.04-07-2016 one time settlement amount.
It is submitted by the learned counsel for the informant that informant is ready to resume the conjugal rights and is not ready to accept the offer of the petitioner with regard to one time settlement amount.
In view of the inconsistent stand of the parties, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Dhanarua P.S. Case No. 454 of 2014, pending in the court of learned Sri Hare Ram, J.M., Ist Class, Masaurhi, Patna.
With the above observation this application is disposed of.
