The petitioners apprehend their arrest in connection with Sanhaula P.S. Case no. 134 of 2016, registered under Sections 447, 384, 504 and 506/34 of the Indian Penal Code. The allegation of informant Abul Kalam is that on 03.02.2016, he was going to see his land and orchard at Sanhaula then in the way petitioners along with one Sk. Jafir began to misbehave with the informant repeatedly saying to give Rs. 50,000/- otherwise they will not allow him to remain in the orchard and cultivate the land. On 03.12.2016 the accused persons destroyed the wheat crops by ploughing the land.

Learned counsel for the petitioners submits that petitioner No.1 has filed the Compliant Case No. 2050 of 2016 in the Court of

Patna High Court Cr.Misc. No.15509 of 2017 (2) dt.11-07-2017 2/2 Chief Judicial Magistrate, Katihar under Sections 323, 120-B, 420, 468 and 467 of the I.P.C. against the informant and due to that reasons the present case has been lodged only to give pressure upon the petitioners.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-V, Bhagalpur in connection with Sanhaula P.S. Case No. 134 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
