JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 120B/34 of the Indian Penal Code and Sections 25(1) (A-A) (A-AA), (B-A), 26, 35 of the Arms Act.
One country made pistol and five live cartridges are said to have been recovered from conscious possession of the petitioner when he along with others had assembled to make preparation for committing dacoity. Petitioner carries criminal antecedent of only one case and is languishing in jail custody since 10.01.2016.
Moreover, some co-accused, having similar allegation, have already been granted privilege of bail.

No.12909 of 2016 (2) dt.31-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Raghwendra Narayan Singh, Judicial Magistrate 1st Class, Danapur, Patna in connection with Bikram P.S. Case No. 04 of 2016.
