Mr. Brajendra Nath Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 30-08-2022 Heard learned counsel for the petitioners and learned APP for the State and also perused the case diary along with the impugned order.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code. It is a case of assault upon the informant and his family members, due to which, three persons sustained injuries. It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that there is case and counter case between the parties. He further submits that there is allegation against the

Patna High Court CR. MISC. No.271 of 2022(3) dt.30-08-2022 2/2 petitioner to inflict upon injured but no injury report was found on the record as yet. He further submits that other coaccused persons got the privilege of anticipatory bail vide Annexure-3 to this petition.

Learned APP appearing for the State opposed the anticipatory bail of the petitioners and submitted that injury report is not annexed with this case diary vide para-87 of the case diary and it is mentioned that after preparing injury report of the injured it will be furnished.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-I, Saran at Chapra in connection with Sonepur P.S. Case No. 326 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
