The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 406/420/506/ 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the entire allegation against the petitioner is of non-performance of his part of agreement with regard to the distribution of shares of the profit derived from the installation of mobile tower. He further submits that the allegation is wholly ornamental and both father and son have been made accused in the present case. It is also submitted that the son of the petitioner who is also similarly placed has been extended the privilege of anticipatory bail in Cr. Misc. No. 6261 of 2016 vide order dated 09.02.2016.

No.12477 of 2016 (3) dt.20-05-2016 P2/2 Considering the aforementioned facts and circumstances and that there is one other case pending against the petitioner, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Nagar Police Station Case No. 09/2015, subject to the conditions as laid down under Section 438(2) of the Cr.
