The petitioners apprehend their arrest in Barun P.S. Case No. 29/2017, registered for the offences punishable under Sections 379, 411, 420 of the Indian Penal Code and sections 3, 4 and 5 of the Bihar Mineral Prevention of Illegal Mining Transportation and Storage Act.
Learned counsel for the petitioners submits that the petitioners are owners of the tractors which were loaded with sand and intercepted by the police. It is submitted that from perusal of annxure-2, it would appear that petitioners were having valid papers for extracting sand from the river.
Considering the facts aforesaid and nature of
Patna High Court Cr.Misc. No.18300 of 2017 (3) dt.11-07-2017 2/2 allegation made against the petitioners, the petitioners abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 29/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
