JUSTICE SANDEEP KUMAR ORAL ORDER 01-11-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kalyanpur P.S.Case No. 149 of 2023 for the offence punishable under Sections 414, 420, 467, 468, 471/34 of the Indian Penal Code and Sections 25 ( 1-b) a, 26, 35 of the Arms Act. As per the prosecution case, the petitioner was arrested while traveling with a stolen vehicle and one country made loaded pistol with four live cartridges were recovered from possession of the petitioner.

Learned cousnel for the petitioner submits that petitioner is innocent and has committed no offence. Nothing incriminating has been recovered from possession of the

Patna High Court CR. MISC. No.69508 of 2023(2) dt.01-11-2023 2/2 possession of the petitioner. He is in custody since 18.05.2023. The petitioner has got five criminal antecedent in which he is on bail.

Learned APP has vehemently opposed the prayer of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class cum Additional Munsif, Samastipur in connection with Kalyanpur P.S. Case No. 149 of 2023.

The petitioner will visit Kalyanpur police station on the first and third Sunday of each month. Any default in appearance at the police station would be result in cancellation of bail bond of the petitioner.
