The petitioner apprehends his arrest in Sadar(Bhalpatti O.P.) P.S. Case No.208 of 2019/G.O. Case No.532 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.
The informant raided the house of one Bina Devi and from her house, 60 bottles each containing 180 ml. and 3 bottles each containing 750 ml. were recovered. Bina Devi is said to have disclosed that the petitioner had come to purchase liquor from her house.
It appears that petitioner was not found at the place of occurrence. The recovery was made from the house of Bina Devi. Nothing has been recovered from the possession of the
Patna High Court CR. MISC. No.58006 of 2019(2) dt.18-09-2019 2/2 petitioner. Name of the petitioner figured on the so called disclosure made by Bina Devi.
Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 2nd-cum-Special Judge(Excise Act), Darbhanga in connection with Sadar(Bhalpatti O.P.) P.S. Case No.208 of 2019/G.O. Case No.532 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
