JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 04-04-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State and also heard the learned counsel for the informant.

The petitioner is seeking regular bail in connection with Khagaria (Gangaur) P.S. Case No. 708 of 2022 registered for offence punishable under section 304(B)/34 of the Indian Penal Code.

As per allegation, the marriage of Manisha Kumari was solemnized with the petitioner in the year 2015. On 15.07.2012 there was some quarrel between the couple. As Manisha Kumari was not well, she was shifted to hospital and she died during the course of treatment.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.59807 of 2022(3) dt.04-04-2023 2/2 that the petitioner is innocent and has falsely been implicated in this case. The cause of death is cardio respiratory failure due to cardiomegaly.

On the other hand, the learned APP has opposed the prayer for bail and submitted that the witnesses have stated that blood was oozing out from mouth and nostrils of the deceased, which is corroborated by the inquest report, which shows that before her death she was assaulted by the petitioner. The learned counsel for the informant has also submitted that line mark was present on right dorsum of hand, which shows that she was beaten before her death.

In my view, it is not a fit case for bail, which is hereby rejected.
