The petitioner apprehends his arrest in a case under Sections 406, 420 of the Indian Penal Code.

The informant alleged that the petitioner and two others came and persuaded him to take the insurance policy of Reliance Company. It is alleged that the petitioner took Rs. 1,20,000/- from the informant and gave one receipt of insurance police showing deposit of Rs. 40,000/- only. It is submitted that the petitioner is not an agent of the Reliance Company; one Arjun Kumar is the agent and he gave receipt to the informant; the petitioner never took any money from the informant. No chit of paper is shown that the informant ever gave any money to the petitioner for depositing the same in the Reliance Company. Learned counsel appearing for the informant has

Patna High Court Cr.Misc. No.12749 of 2016 (3) dt.27-06-2016 2/2 opposed the prayer for anticipatory bail to the petitioner and submitted that the petitioner had agreed to return the money before the villagers in the panchayati but this fact has been denied by the learned counsel for the petitioner.

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Turkaulia P.S.
