2. On 01.08.2024 an order was passed in which the consent of the parties the Maintenance Case No. 180/2016 which was pending before the Court of learned Principal Judge, Family Court, Hajipur was transferred to Court of learned Principal Judge, Family Court, Patna.

3. Now, a modification petition has been filed by Richa Kumari submitting that she is a regular practitioner but it is hard to maintain financially in Patna and as such she will be comfortable with her parents at Purnia instead of remaining at costly town Patna.

4. It is to be recorded that both the parties were

Patna High Court MJC No.3065 of 2024(03) dt.14-02-2025 2/2 present before this Court on 01.08.2024 and it was only with their consent that their learned counsels, wanted that the matter to be transferred to the Court of learned Principal Judge, Patna. Now, the lady wants the re-transfer of the case. This Court is afraid, the Court cannot be used as a tool by the lady to harass the husband. This Court reference from imposing cost upon the lady.

5. However, for the ends of justice both the petitioners as well as the opposite party (Richa Kumari and Anand Kumar) will have the option to appear either physically or through video conferencing before the learned Principal Judge, Family Court, Patna in Maintenance Case No. 180/2016. In that circumstances, she will have the option to remain in Purnia/elsewhere/wherever she wants to reside.

6. The order dated 01.08.2024 stands modified to that extent.
