JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-09-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Dumaron Police Station Case No. 149 of 2017, disclosing offences under Sections 420/34 of the Indian Penal Code and 3/4 of the D.P. Act.
Learned counsel for the petitioners has submitted that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, the F.I.R. has been lodged after lapse of 25 days from the date of occurrence without explaining plausible delay, which itself creates doubt over the prosecution version. As a matter of fact, earlier threatening was given to the petitioners by the informant along
Patna High Court Cr.Misc. No.33398 of 2017 (3) dt.06-09-2017 with family members and in this regard the petitioner No.1 has filed a Sanha in the Dumaraon police station, which is evident from annexure-2. The petitioners have falsely been implicated in this case. Hence, the petitioners deserve the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Dumaron Police Station Case No. 149 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
