The petitioners apprehend their arrest in Chanan P.S. Case No.6 of 2018 registered under Section 307 and other Sections of the Indian Penal Code.

The S.H.O. of Chanan alleged that he got information about the hiding of a naxalite, Dinesh Yadav. The police raided the house and apprehended Dinesh Yadav but while the police was bringing Dinesh Yadav after his arrest to police station, many villagers became amok and attacked on the police force in which Dinesh Yadav managed to flee away.

The learned counsel for the petitioners submits that the petitioners are ladies. They are of course named in the F.I.R. by

Patna High Court Cr.Misc. No.25731 of 2018 (2) dt.03-05-2018 the name of their husband but in fact, they did not participate in the occurrence. The villagers raised protest against the highhandedness of the police. The petitioners have no manner of concern with Dinesh Yadav. The petitioners happen to be wife of the brothers of Dinesh Yadav.

Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that the petitioners are ladies, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Chanan P.S. Case No.6 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
