JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420 and 506/34 of the Indian Penal Code.

It is alleged that petitioner no.1 and Akhilesh Prasad Choudhary came and asked the complainant to vacate the land on which the complainant constructed his house after purchase, consequently the complainant came to know that the co-accused Akhilesh Prasad Choudhary, the husband of petitioner no.1 transferred the land in question in favour of his wife in the year 2010 from the father-in-law of petitioner no.1 namely Ram Dayal Choudhary. Petitioner no.2 is the scribe of deed in question. It is submitted by learned counsel for the petitioners that

Patna High Court Cr.Misc. No.29966 of 2015 (2) dt.30-07-2015 2/2 the husband of petitioner no.1 and the complainant is the own brother and the land has been transferred by the bona fide land owner.

Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., Saharsa in connection with Complaint Case No. 1282C of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
