The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 364, 120B of the Indian Penal Code.
Accusation is of kidnapping the minor daughter of the informant.
It is submitted by the learned counsel for the petitioner that under Section 164 Cr.P.C. statement the victim got her age recorded 20 years, the Court also assessed her aged 17 years but during medical examination of the informant the Doctor found her age between 20-21 years. In 164 Cr.P.C. statement she has stated that she has married with the petitioner with her own.
Considering the statement under Section 164
Patna High Court Cr.Misc. No.29271 of 2015 (2) dt.27-07-2015 Cr.P.C ., let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Katihar in connection with Balrampur P.S. Case No. 92 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
