The petitioner apprehends his arrest in Excise Case No. 09/2015, registered for the offences punishable under Section 47(A)(F) of the Excise Act.
Learned counsel for the petitioner submits that from perusal of the prosecution witness itself, it would appear that the liquor was recovered from the bank of Sone river. The complainant has falsely implicated the petitioner in the case. Name of the petitioner has been mentioned on mere suspicion. Considering the facts aforesaid and the fact that liquor was recovered by the side of bank of river, the petitioner above-named, in the event of his arrest or surrender before the

No.19657 of 2017 (2) dt.12-07-2017 2/2 court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Dehri, Rohtas in connection with Excise Case No. 09/2015, subject to the conditions as laid down under Section 438(2) of the Cr.
