2. The petitioners apprehend arrest in connection with Banke Bazar P.S. Case No. 70 of 2025 dated 22.05.2025, registered for the offence punishable under Sections 126(2), 115(2), 109, 352, 351(2), 303(2) and 3(5) of the Bharatiya Nayay Sanhita, 2023.
3. The prosecution case, in short, is that the petitioners along with three others is said to have assaulted the informant
Patna High Court CR. MISC. No.63108 of 2025(2) dt.10-09-2025 2/3 and her husband due to which her husband sustained head injury and they also snatched gold mangalsutra from her.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is submitted that both the sides are agnates. It is submitted that there is no specific allegation against the petitioners, rather, the allegations against the petitioners are general and omnibus. It is further submitted that there is case and counter case between both the sides. Counter case bearing Banke Bazar P.S. Case No. 73 of 2025 has been filed against informant's side. It is also submitted that both the sides have jointly filed a compromise petition in the court below since good sense have prevailed between them. before the concerned court. Lastly, it has been submitted that the petitioners have no criminal antecedent.
5. Learned A.P.P. has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Banke Bazar P.S. Case No. 70 of 2025, they shall be released on anticipatory bail
Patna High Court CR. MISC. No.63108 of 2025(2) dt.10-09-2025 3/3 upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-Ist Class, Sherghati, Gaya, subject to condition as laid down under Section 482(2) of B.N.S.S..
