====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 15-11-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. Petitioners seek regular bail in connection with Kopa P.S. Case No.27 of 2025 registered for the alleged offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 3(5) of the B.N.S., 2023.
3. As per prosecution case, when the informant had gone towards the western field from his house for the purpose of defecation, he was surrounded and abused by the accused persons including the petitioners due to previous dispute. It is also alleged that all the accused persons assaulted the informant
Patna High Court CR. MISC. No.64646 of 2025(3) dt.15-11-2025 2/3 by knife, sticks and they also snatched Rs.2,500/- alongwith a gold chain and Mobile from the informant.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case due to previous enmity. He further submits that both the parties are resident of same locality. Learned counsel submits that there is no recovery of any alleged weapon and the allegation made by the informant against the petitioners are not corroborated by the medical evidence. He further submits that petitioners are in custody since 20.06.2025 and they have got clean antecedent. Learned counsel submits that charge sheet had already been submitted in this case after completion of investigation. He further submits that there is no likelihood of absconding the petitioners or tampering with the evidence and they undertake to cooperate in the trial of the case.
5. Learned APP for the State opposes the prayer for grant of bail to the petitioners.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and the period of custody, let the petitioners, named above, be enlarged on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the
