The petitioner apprehends his arrest in connection with Sugauli P.S. Case No. 248 of 2016 instituted for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code.
It is alleged that the F.I.R. named accused persons took amount for getting the informant employed as Coordinator in Nagar Panchayat Sugauli, Block-Sugauli, District-East Champaran. The allegation of taking an amount of Rs. 1,00,000/- is against Vijay Swaraj and the amount of Rs. 1,32,000/- and Rs. 68,000/- against Indradeo Kumar and Sudhir Kumar. The allegation against this petitioner is that he persuaded
Patna High Court Cr.Misc. No.39443 of 2017 (3) dt.17-10-2017 the informant and said that he will get an amount of Rs. 10,000/- per month as salary. There is nothing specific allegation against this petitioner.
The learned A.P.P. for the State, on the other hand, opposed the submission.
Considering the nature of allegation, facts and circumstances of case, the anticipatory bail prayer is allowed. The petitioner, above named, in the event of arrest / surrender within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S. Case No. 248 of 2016, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Sanjay Kumar, J) ajay gupta/- U T
