Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code in connection with Mansi P.S. Case No. 12/2018.
Allegation against the petitioner is of abducting the daughter of the informant.
Submission of the learned counsel for the petitioner is that the statement of the victim girl under Section 164 of the Cr.P.C. itself shows that the main allegation is against other coaccused and not against the petitioner, rather he has cooperated the victim girl.
Patna High Court Cr.Misc. No.28278 of 2018 (2) dt.17-05-2018 2/2 Heard the learned Additional Public Prosecutor also who has opposed the prayer for anticipatory bail on the ground that the hand of the petitioner also transpires in this case. In view of the aforesaid facts and the statement of the victim under Section 164 of the Cr.P.C., I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail is rejected.
If the petitioner surrenders before the court below and prays for regular bail, his prayer shall be considered on the merit of the case without being prejudiced by this order. (Vinod Kumar Sinha, J.) Rakhi U T
