JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-09-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Rajoun Police Station Case No. 97 of 2017, disclosing offences under Sections 366(A)/34 of the Indian Penal Code. Learned counsel for the petitioners has submitted that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, the petitioner Nos. 1, 2 and 3 happen to be younger brother, mother and Mousi, respectively, of Tinku Kumar Ranjan, who is said to have abducted the victim, Karina Kumari for performing marriage. As a matter of fact, there was lover affair between the victim and
Patna High Court Cr.Misc. No.33568 of 2017 (4) dt.06-09-2017 Tinku Kumar Ranjan and the victim out of her sweet will has performed marriage and they are living together out side of State. These petitioners have no concern with the alleged occurrence, even no cogent material has come against the petitioners during course of investigation. Hence, the petitioners deserve the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Rajoun Police Station Case No. 97 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
