This application is filed for Modification of order dated 15.12.2017 passed in Cr. Misc. No. 41127 of 2017. Learned counsel appearing on behalf of the petitioner submits that vide order dated 15.12.2017 passed in Cr. Misc. No. 41127 of 2017 the petitioner was ordered to be released on bail in the event of his arrest or surrender before the court below within the period of four weeks on furnishing the bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-XI, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 66 of 2015, but due to death of his uncle, the

Patna High Court Cr.Misc. No.18452 of 2018(2) dt.02-05-2018 2/2 petitioner could not surrender before the trial Court within the stipulated time.

In such view of the matter, the time to surrender of petitioner, as per order dated 15.12.2017 passed in Cr. Misc. No. 41127 of 2017, is further extended by four weeks from today in connection with aforesaid case.

Accordingly, the modification application is allowed and the order dated 15.12.2017 passed in Cr. Misc. No. 41127 of 2017 is modified to the above extent.
