JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 19.12.2015 in a case registered for the offences punishable under sections 399, 402, 415 of the IPC, under Section 25(1-b)A of Arms Act and under Section 20/22 of the N.D.P.S. Act.

The prosecution case is that six miscreants were intercepted while travelling on two Pulsar motor cycles. From the possession of other miscreants arms, ammunition and 2.5 Kg. of Ganja were recovered. From the possession of the petitioner one Nokia mobile was recovered.

It is submitted by learned counsel for the petitioner that neither arms nor Ganja was recovered from the petitioner, hence, none of the alleged offences are made out against the petitioner and only on suspicion the petitioner has been roped in this case. The investigation has already been concluded.
