The petitioner is apprehending her arrest in connection with Aurangabad (M) P.S. Case No. 56 of 2014 registered for the offences punishable under Sections 414/34 of the Indian Penal Code and 3, 4 & 5 of Explosive Substance Act. Petitioner is not named in the FIR and it appears that later on his name transpires in this case and further he has been made accused in four other cases.
It has been submitted on behalf of the petitioner that there is delay in lodging FIR of five hours and petitioner has not been named and his name transpires after two years and nine months in the confession of co-accused and nothing has been recovered from his possession. So far criminal antecedents are
Patna High Court Cr.Misc. No.36712 of 2017 (2) dt.18-08-2017 2/2 concerned, it has been submitted that all the cases relate to minor offences.
Heard learned APP also, who has opposed the prayer for anticipatory bail.
Having heard both sides and in the facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.
Let petitioner surrender before the court below and pray for regular bail, which shall be considered on the basis of the submission made above, if possible, on the same day, without being prejudiced by this order.
With the above observation, this application is dismissed.
