The petitioner apprehends his arrest in connection with Singhia P.S. Case no. 169 of 2017, registered under Sections 307, 323, 341, 379, 504 and 506 of the Indian Penal Code.

The accusation is that on 27.12.2017, regarding the occurrence of quarrel between the children, the informant Rajesh Kumar Singh was talking with somebody, in the meantime, Sonu Kumar Singh (Petitioner) came there and cause injury through axe thrice at the head and chest of the informant and also snatched his golden chain and moved from there giving threatening to kill the informant and his family.

No.28742 of 2018(2) dt.10-05-2018 2/2 Learned counsel for the petitioner submits that, in fact, on petty matters, children were started scuffle and at that time hot talks were exchanged, but with ulterior motive, the informant lodged the present case. Moreover, no injury was found on the person of the informant and the injury report as submitted by the informant is of Chhotu Kumar Singh in which two injuries were detailed, which are of simple in nature caused by hard and blunt substance. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Rosera in connection with Singhia P.S. Case No. 169 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
