Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307, 324, 379 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, petitioner No.1 gave Axe blow on the head of informant and petitioner No.2 assaulted him with iron rod on his left hand.

It is submitted that both parties are Pattidars and due to petty dispute scuffle took place in which both sides sustained injuries. Petitioners have got clean antecedent. Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.9 of 2022(4) dt.29-09-2022 2/2 prayer for anticipatory bail and submits that petitioners are named in the FIR and there is direct and specific allegation against them of assaulting the informant. The informant sustained grievous injuries.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
