JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard the learned counsel for the petitioners as well as the learned for the State.

The petitioners are languishing in custody since 13.04.2015 in a case registered for the offences punishable under sections 447, 341, 323, 324, 307, 427, 504 and 34 of the I.P.C. It is alleged against the petitioners that they assaulted the informant with farsa on his head with intention to kill which was prevented by him by his right hand and consequently he sustained injury on his hand.

It is submitted by learned counsel for the petitioners that out of eight injuries six injuries have been caused by hard and blunt substance and two have been caused by sharp cutting

Patna High Court Cr.Misc. No.26242 of 2015 (2) dt.27-07-2015 2/2 weapon, though one injury was found to be grievous. It is further submitted on behalf of the petitioners that there is counter version of the occurrence. Moreover, investigation has already concluded and a statement has been made in paragraph-3 of the petition that the petitioners have got no criminal antecedents. Considering the above mentioned facts, the above named petitioners are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M. Madhubani in Saharghat P.S. Case No. 12 of 2014.
