JUSTICE SATYAVRAT VERMA ORAL ORDER 13-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 302 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 27.09.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and is a woman.

The informant alleges that on 31.03.2021, at about 9:00 am his son Deepak along with the petitioner (wife of Deepak) were quarreling with the informant on account of land dispute, it is next alleged that on account of quarrel, Deepak fired upon the informant but he missed and the bullet hit the informant's daughter, Gunjan Kumari (victim) causing her death

Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R. it would manifest that it was Deepak who fired causing death of his own sister, Gunjan Kumari and as far as this petitioner is concerned, it is alleged that she along with Deepak was fighting with the informant who is the father of Deepak. It is thus submitted that petitioner is not the assailant.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 27.09.2021, is a person with clean antecedent, chargesheet has been submitted in the case, is a woman and is not the assailant, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Akbarnagar P.S.
