JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 307, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is a case of misuse of privilege of bail and it would appear from perusal of the impugned order that bail bond of the petitioner was cancelled on 09.04.2014 as he failed to appear before the trial court but petitioner is in jail custody since 27.02.2015 and it appears that he has sufficiently been punished for the aforesaid fault.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
Patna High Court Cr.Misc. No.18553 of 2016 (3) dt.03-05-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Sitamarhi in connection with Sessions Trial No. 532 of 2006 arising out of Sonbarsa P.S. Case No. 49 of 1998, subject to condition that he shall attend the trial court on each and every date in person for the period of six months or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
