JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the informant and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Hasanganj P.S. Case No. 54 of 2016, registered under Sections 302 & 201/34 the Indian Penal Code.

The accusation is that on 25.12.2016 at about 4.00 P.M. Chitranjan Kumar @ Chhitu, brother of the informant, had gone to watch match having cash of Rs. 30,000/- and ATM Cards with him, but he did not return and his mobile was also found switched off. On the next day, informant came to know about lying of a dead body in the orchard near Barki Ratni then he along with his villagers went to Sadar Hospital, katihar and identified the dead body of his brother. Further allegation of informant is that his brother was reading along with one Punam Kumari at Patna and there was love affair between

Patna High Court Cr.Misc. No.15855 of 2017 (2) dt.13-07-2017 2/2 them, due to that reasons, Ramesh Paswan and Sonu Paswan being the brother-in-law and brother of Punam Kumari had given threatening to his brother for dire consequences as such they have hand in the murder of his brother.

Learned counsel for the petitioner submits that in course of investigation only suspicion has been raised by the informant and witnesses having hand in the murder of the brother of the informant, while A.T.C. card was found from the possession of co-accused Sujit Kumar Singh and petitioner has no concern in any manner. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Katihar in connection with Hasanganj P.S. Case No. 54 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
