====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 22-05-2018 Heard learned counsels for the petitioner and the State. The petitioner apprehends his arrest in connection with Kasimbazar P. S. Case No. 300 of 2017 instituted under Sections 498A/34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that petitionerhusband is ready to take back his wife with full dignity and honour.
Whereas learned counsel appearing on behalf of the informant submits that wife is also ready to go back to her matrimonial home with petitioner.
Having considered the aforesaid facts and circumstances, let the petitioner, namely, Md. Sajid, in the event of arrest or surrender before the court below within four weeks from today,
Patna High Court Cr.Misc. No.32117 of 2018(2) dt.22-05-2018 2/2 be released on provisional bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Munger in connection with Kasimbazar P.S.Case No. 300 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973, for three months from the date of passing of this order. In the meanwhile, petitioner will take back his wife to her matrimonial home and keep her with full honour and dignity. If trial court finds both are living amicably, petitioner's provisional anticipatory bail shall be confirmed, otherwise provisional bail bond shall be cancelled. The application stands disposed.
