The petitioner seeks bail in connection with Lalganj P.S. Case No. 117 of 2021 registered for the offence punishable under Section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 16.08.2021, charge-sheet has been submitted in the case and has antecedent of four cases and the informant alleges that on 23.03.2021 at about 8:00 P.M. while he was going back home from his shop, he was intercepted by three unknown motorcycle borne criminals near Railway Gate

Patna High Court CR. MISC. No.752 of 2022(2) dt.23-05-2022 2/3 no. 10, who looted his motorcycle along with other article and cash as detailed in the FIR.

The learned counsel submits that the FIR was against unknown, the name of this petitioner transpired during the course of investigation, it is next submitted that petitioner despite being in custody has not been put on TIP nor any incriminating article was recovered from his possession and he was implicated merely because of his antecedents. The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 16.08.2021, charge-sheet has been submitted in the case and was not put on TIP nor any incriminating article was recovered from his possession, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Lalganj P.S. Case No. 117 of 2021 with a condition that one of the bailor shall be the father of the petitioner Raghunath Ram.

Further if the learned court below comes to a conclusion that petitioner after his release is trying to delay the
