JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 The petitioner is languishing in custody since 14.01.2015 in connection with Goria Kothi G.B. Nagar P.S. Case No. 07 of 2015 for the offences instituted under Sections 25(1-b) A and 26 of the Arms Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 13.01.2015 at 9 A.M. the informant Udhav Ji Singh S.I.-cum-in- charge of G.B. Nagar P.S. was on patrolling duty alongwith Arms constable. During the patrolling suspected one person seeing the police he wanted to flee away but the police caught hold and on search in the presence of witnesses one country made looted pistol was recovered from his wrist on being asked by the informant the

Patna High Court Cr.Misc. No.25039 of 2015 (2) dt.20-07-2015 2/2 arrested accused disclosed his name Dharmendra Nat (petitioner) the seizure list was prepared in the presence of the witnesses. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.01.2015 and the charge sheet has been submitted in the present case. It is further submitted that from possession of petitioner, one country made pistol and one live cartridge is said to have been recovered. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan, in connection with Goria Kothi G.B. Nagar P.S. Case No. 07 of 2015.
