JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-07-2018 The petitioners seek bail in anticipation of their arrest in connection with Laukaha P.S. Case No. 225 of 2017, dated 04.10.2017, instituted for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 379, 427 and 504 of the Indian Penal Code.
The petitioners and others are said to have
Patna High Court Cr.Misc. No.33907 of 2018 (2) dt.05-07-2018 2/2 assaulted the informant and his associates and also divested them of their belongings.
There is counter version of the occurrence as well and many persons from the side of the petitioners also have been injured. The injuries suffered by the victims of the present case are not in consonance with the ocular testimony. There is a land dispute and the two cases referred to above are the result of the aforesaid dispute. The petitioners do not have any criminal antecedents.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, Jhanjharpur (Madhubani) in connection with Laukaha P.S. Case No. 225 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
