The petitioners apprehend their arrest in Budha Colony P.S. Case No. 46/2017, registered for the offences punishable under Sections 406, 379 and other sections of the Indian Penal Code and under section 138 of the Negotiable Instruments Act.
The informant alleged that he entered into an agreement with Ravi Ranjan Kumar Ojha @ Ravi Ojha petitioner no. 1 to invest in a partnership business. The informant gave Rs. 3,51,000/- in cash and cheque, but the same was not honoured. When the informant went to demand money, petitioners are alleged to have assaulted.
Patna High Court Cr.Misc. No.34500 of 2017 (2) dt.10-08-2017 2/2 Learned counsel for the petitioners submits that petitioner no. 1 did not borrow any money. The informant invested the money in partnership business. Petitioner no. 1 has already deposited the entire amount in the account of the informant which would appear from perusal of annexure-3.
Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Patna in connection with Budha Colony P.S. Case No. 46/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
