JUSTICE RAKESH KUMAR ORAL ORDER 04-07-2018 Heard Sri Manoj Kumar , learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Matihani P.S. Case No. 193 of 2017, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender purely on parity. It has been argued that one of the co-accused namely: Raj Kishore Singh from whose land there was recovery of huge quantity of Indian make foreign liquor has already been extended the privilege of anticipatory bail on 15.05.2018 vide Cr. Misc. No. 29648 of 2018. Besides this, it has been argued that petitioner is having clean antecedent and only on suspicion petitioner has been made accused.

Patna High Court Cr.Misc. No.38157 of 2018(2) dt.04-07-2018 2/2 Be that as it may, considering the fact that one of the co-accused from whose land recovery was affected has been granted anticipatory bail, there is no reason to refuse the same relief to the petitioner.

Accordingly , in the event of his arrest or surrender within a period of six weeks from today, let petitioner Gauri Shankar Singh @ Gauri Shanker be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge - II cum Spl. Judge Excise, Begusarai / concerned court in connection with Matihani P.S. Case No. 193 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J) praful/- U T
