JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 307, 447, 379 and 34 of the Indian Penal Code.
The prosecution case, in short, is that the informant gave his farbayan on 4.8.2014 at Emergency Ward, Sadar Hospital, Jamui alleging therein that in the night when he was sleeping in his house, in the meantime, all the accused persons armed with lathi and danda came there and abused him for old land dispute. On protest, he was assaulted and accused persons also snatched golden chain.
Patna High Court Cr.Misc. No.26384 of 2015 (2) dt.20-07-2015 On behalf of the petitioners, it is submitted that the petitioners and the informant are agnates. It is further submitted that due to land dispute, the petitioners have falsely been implicated in the present case. The injury report, which is Annexure-3, indicates that the injuries are simple in nature. On behalf of the State and the informant, it is submitted that the petitioners are named in the first information report. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 206 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sudhir Singh, J) V.P.Sinha/- U
