The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 30 litres of country liquor was recovered from the possession of the petitioner while the other accused managed to escape.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 11.11.2021 and has no criminal antecedent. It is further submitted by learned counsel for the petitioner that a supplementary affidavit has been filed stating therein about the medical condition of his wife.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner not having any criminal antecedent and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Hajipur Sadar P.S. Case no. 995 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II - cum - Excise Court, Vaishali at Hajipur.
