JUSTICE AMARESH KUMAR LAL ORAL JUDGMENT Date: 30-04-2015 Heard learned counsel for the petitioners and the State. This application has been filed for quashing the order dated 25.7.2012 passed by the learned Chief Judicial Magistrate, Gaya in Chandauti P. S. Case No. 330 of 2011 by which cognizance has been taken against the petitioners for the offence punishable under Sections 420, 467, 468 and 471 IPC. Learned counsel for the petitioners submits that the petitioners have not committed any offence and the case is of civil nature.
It appears that after investigation the police has
Patna High Court Cr.Misc. No.49743 of 2012 dt.30-04-2015 2/2 submitted charge-sheet and on perusal of first information report and the material available on the record, the learned Magistrate has taken cognizance.
Considering the facts and circumstances, I do not find any ground to interfere with the impugned order. However, the petitioners will be at liberty to raise their grievance at the time of framing of charge.
