JUSTICE RAKESH KUMAR ORAL ORDER 27-07-2016 The sole petitioner has approached this Court, invoking its inherent jurisdiction under Section 482 of the Code of Criminal Procedure, with a prayer to quash an order dated 21.10.2013 passed by learned Adhoc Addl. Sessions Judge-IV, Patna in Sessions Trial No.821/2013 arising out of Kadamkuan P.S. Case no.350/2012 registered for the offence under Sections 302, 120(B)/34 of the Indian Penal Code, 27 of the Arms Act and Sections 3 and 4 of the Explosive Substance Act. By the said order, the learned court below has rejected the petition for discharge filed on behalf of the petitioner under Section 227 of the Code of Criminal Procedure.
Sri Amit Kumar Rakesh, learned Addl. Public Prosecutor submits that there is specific accusation against the
Patna High Court Cr.Misc. No.53613 of 2013 (3) dt.27-07-2016 2/2 petitioner. He submits that the deceased was done to death and the deceased before the death had disclosed that this petitioner had conspired in the occurrence.
Besides hearing learned Addl. Public Prosecutor, I have also perused the materials on record. After going through the same, the Court is satisfied that there is no ground for interference with the impugned order.
The petition stands dismissed with observation that the court below may take all steps for early disposal of the case. Let a copy of this order be sent to the court below forthwith (Rakesh Kumar, J) NKS/- U T
