The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 392 of the Indian Penal Code and Section 27 of Arms Act.

Patna High Court CR. MISC. No.68734 of 2023(3) dt.29-01-2024 2/3 As per allegation in the FIR, two miscreants are said to have intercepted the vehicle of the informant and fired upon him. Thereafter, they snatched the vehicle of the informant along with some documents and a mobile phone and fled away.

It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have committed no offence. They have falsely been implicated in the present case. Neither the petitioners are named in F.I.R. nor they have been put on T.I.P. The name of petitioner, Ranjan Kumar (Cr. Misc. No. 68734 of 2023) sprang up in this case on the confessional statement of co-accused Kuldip Kumar Jha and name of petitioner, Sunil Kumar Sahu (Cr. Misc. No. 78410 of 2023) sprang up on the basis of spy. Moreover, the petitioners are languishing in judicial custody since 05.07.2023. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Similarly situated several co-accused persons have been granted bail by this Court as well as co-ordinate Bench of this Court.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Phulparas P.S. Case No. 364 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Jhanjharpur, Madhubani.
